General Terms and Accommodation Agreement

Welcome to Kalkan Port Villas. By accessing our website, making a reservation, and staying at our properties, you acknowledge that you have read, understood, and agreed to be bound by the following Terms and Conditions. These terms constitute a legally binding agreement between Kalkan Port Villas ("Management", "We", or "Us") and the guest ("You" or "Guest").

1. Booking, Payment, and Validity

1.1. Validity of Reservation: A reservation is only considered confirmed and legally binding once the required prepayment or full payment has been successfully received within the specified timeframe. Reservations for which payment has not been made or completed are strictly invalid and will be automatically canceled by the system without prior notice.

1.2. Pricing: Prices are quoted in the agreed currency. The Management reserves the right to amend rates prior to a confirmed booking. Once a booking is confirmed with payment, the price is guaranteed.

2. Check-in and Check-out Procedures

To ensure our villas are thoroughly cleaned, sanitized, and maintained to the highest standards for every arriving guest, the following strict timelines apply:

• Check-in Time: Guests may check in starting from 16:00 (4:00 PM).
• Check-out Time: Guests must vacate the property no later than 11:00 AM.

Late check-outs without prior written approval from the Management may result in a penalty fee equivalent to an additional night's stay, as it disrupts the preparation process for incoming guests.

3. Rules of Conduct and Nuisance

3.1. Respect for the Environment and Neighbors: Our villas are located in a peaceful and serene environment. Guests are strictly required to avoid any behavior that may cause a disturbance to the environment, neighboring properties, or local residents.

3.2. Noise Restrictions: Loud music, excessive noise, shouting, and disruptive parties are strictly prohibited, especially between the quiet hours of 22:00 (10:00 PM) and 08:00 AM. Kalkan Port Villas maintains a strict "No Party/Event" policy unless prior written consent is granted.

3.3. Occupancy Limits: The number of guests must not exceed the maximum capacity stated during the reservation. Unregistered visitors or overnight guests are not permitted due to local legal regulations and safety protocols.

4. Right to Terminate Accommodation and Cancel Bookings

4.1. Immediate Eviction: Kalkan Port Villas reserves the absolute right to cancel reservations or terminate the accommodation immediately, without any refund, if guests are found to be:

• Causing severe disturbance to the environment or neighbors (as per Section 3).
• Exceeding the maximum villa capacity or bringing unauthorized guests.
• Engaging in any illegal activities under the laws of the Republic of Turkey.
• Causing intentional damage to the property, fixtures, or fittings.
• Displaying abusive or threatening behavior towards the staff or local residents.

In such events, the Management is legally exempt from providing any compensation or alternative accommodation.

5. Liability and Damages

5.1. Guest Liability: Guests are fully responsible for all items, fixtures, and structural elements within the villa during their stay. Any loss, damage, or excessive cleaning requirements caused by the guest will be charged directly to the guest or deducted from the security deposit.

5.2. Management Liability: Kalkan Port Villas is not liable for any personal injury, illness, loss, or damage to guests' personal belongings, vehicles, or valuables during their stay. Guests are strongly advised to secure comprehensive travel insurance prior to their trip.

6. Distance Selling Contract (Mesafeli Satış Sözleşmesi)

By completing an online payment, the guest agrees to the terms of the Distance Selling Contract pursuant to the Turkish Consumer Protection Law No. 6502. Cancellation requests, refunds, and date modifications are subject to the specific cancellation policy presented at the time of booking. Non-refundable rates are strictly ineligible for refunds under any circumstances.

7. Privacy Policy and Data Protection (KVKK / GDPR)

7.1. Data Collection: In accordance with the Turkish Personal Data Protection Law (KVKK No. 6698) and the Identity Notification Law (Law No. 1774), we are legally obligated to collect and process personal data, including names, passport/ID numbers, and contact details of all staying guests.

7.2. Data Usage: This data is solely used to register guests with the local gendarmerie/police (GIYKIMBIL system), process payments, and improve our services. Your personal data is stored with high-security standards and is never shared with third parties, except where required by law enforcement or judicial authorities.
